VIOLATION SANCTIONS AND FINES

 

Section 25 – Penalties for Violations of these Rules:

The Policies that govern the application of fines or penalties for violation of these Rules are contained in the SCCMLS Penalty Policy. A copy of this Policy can be found in the MLS System and the SCCBR web site (www.sccazrealtor.com). If two or more violations exist with the violations shall be noticed and handled together and the provisions applicable to the more severe violation shall prevail.

 

Section 25.1 – Schedule of Fines for Violations:

The attached table list is an appendix to the SCCMLS Penalty Policy of current fines for listing violations that relate to information filed improperly with the MLS. The MLS Standards Committee has the right and obligation to enforce these policies and any alleged violation of our Rules and Regulations in accordance to Section 7 and Section 9 of the MLS Rules and Regulations. Violations other than those stated below are subject to review and issuance of a determined fine amount.

 

(A) Failure to Pay Service Charges:

When Participant fails to pay service charges SCCMLS will impose following penalties and suspension of service as follows:

  • 7.1 (C)   Suspended for Sixty (60) days, Apply as new member    Payment of ALL Fees Owed
  • 7.1 (C)  Reinstatement following any suspension                        Reconnection Fee $100
  • 7.1 (D)   Check with insufficient funds/5 days from notice            Fees and Return Check Fees
  • 7.1 (D)   2nd insufficient funds check in 6 months                        Cert. Money Order or Cash  

 

(B) Minor Violation:

The Policies that govern the input of data information in the MLS system is contained in the SCCMLS Do’s & Don’ts Policy. When a listing inaccuracy is found and/or an error message is reported by the MLS system notification the listing Subscriber has two (2) business days to correct the listing per notice. If not corrected within the grace period a subsequent warning by LEVEL I and any other Level of Severity thereof will be imposed for the following SCCMLS Rules and Regulations infractions:

(C) Automatic Violation:
The Policies that govern the input of data information in the MLS system is contained in the SCCMLS Do’s & Don’ts Policy. When an infringement is found and/or error message reported by the MLS system notification subsequent automatic penalties will be assessed by LEVEL III and any other Level of Severity thereof will be imposed for the following SCCMLS Rules and Regulations infractions:

  • 2.7 – Advertising                         Advertising the Listing of another Broker without Permission
  • 12 – MLS Compilation                   Providing Listing Info from another Agency to Non-Subscribers  
  • 12.2 (A) – Distribution                  Providing Privately Viewable Data Fields to the Public
  • 12.2 (D) – Distribution                  Providing Privately Viewable Data Fields to Non-Subscribers
  • 12.2 (E) – Distribution                  Providing Sold Comparables to Non-Subscribers
  • 21.5 – Key Replacement               Not Replacing Key in Keysafe/Lockbox and/or Keybox

(D) Severe Violation:
When an infringement is found and/or an error message is reported by the MLS system notification subsequent penalties will be assessed by LEVEL V and any other Level of Severity thereof will be imposed for the following SCCMLS Rules and Regulations infractions:

In addition to receiving a fine, Subscribers penalized may also be required to attend education and training as determined by the MLS Standards Committee, or Subscribers may be referred to the SCCMLS Board of Directors with their Participant for decision regarding fine up to $15,000 and suspension of service for a minimum of 30 days and a maximum of three years.

 

Section 25.2 – Timelines:

Definitions of a Day, Business Days, and Date of Notice are as follows:

 

  • A Day shall begin at 12:00:00 AM (Midnight) on the day immediately following the event or situation that invoked the defined term and shall end at 11:59:59 PM that same day.
  • Business Days are Monday through Friday, excluding weekends and holidays.
  • Two (2) Business Days does not include the Date of Notice and/or Date of Occurrence.

 

Section 25.3 – Grace Period:

Business days to act in accordance with SCCMLS Rules & Regulations or resolve MLS system electronic violation notification before incurring a fine.
