CONFIDENTIALITY
OF MLS INFORMATION
Section 10 - Confidentiality of MLS Information:
Any information provided by the MLS to
the Participants shall be considered official information of SCCMLS. Such information shall be considered
confidential and exclusively for the use of Participants and real estate
licensees affiliated with such Participants and those Participants who are
licensed or certified by an appropriate state regulatory agency to engage in
the appraisal of real property and licensed or certified by an appropriate
state regulatory agency to engage in the appraisal of real property and
licensed or certified appraisers affiliated with such Participants.
Section 10.1 - MLS Not Responsible for
Accuracy of Information:
The
information published and disseminated by SCCMLS is communicated verbatim,
without change by SCCMLS as filled with SCCMLS by the Participant. SCCMLS does
not verify such information provided and disclaims any responsibility for its
accuracy. Each Participant agrees to hold SCCMLS harmless against any
liability arising from any inaccuracy or inadequacy of the information such
Participant provides.
(A) Except, to the extent that SCCMLS
reserves the right to REJECT and remove or make modification in order to
correct system field revisions and errors and to be compliant with Fair Housing
laws, Arizona Department of Real Estate laws, Appraisal laws, SCCMLS Rules and
Regulations.
(B) Each Participant and/or Listing
Subscriber shall be responsible to ensure the following of a published Listing:
(1) What ever is verbally stated to the
Public and Members coincides with the dissemination of information for the
published listing in the MLS system.
(2) In the event, a disclosure is
determined to be of importance to a published listing but not found in the MLS
system the Subscriber shall be responsible in requesting a new description
field and/or guidance by SCCMLS of how to disclose information in the MLS
system.
(3) For the listing submitted to be
compliance with Fair Housing Standards, Arizona Department of Real Estate laws,
Appraisal laws, SCCMLS Rules and Regulations.
(C) If SCCMLS makes a modification for the
Participant, the Participant will receive an electronic notice of the field
that was corrected. If a correction notice is received by the Participant, the
Participant may request clarification and/or dispute change.
Section 10.2 - Access to Comparable and Statistical
Information:
Board members who are actively engaged
in real estate brokerage, management, mortgage financing, appraising, land
development, or building, but who do not participate in the MLS, are
nonetheless entitled to receive by purchase or lease all information other than
current listing information that is generated wholly or in part by the MLS,
including “comparable” information, “sold” information, and statistical
reports. This information is provided for the exclusive use of Board members
and individuals affiliated with Board members who are also engaged in the real
estate business and may not be transmitted, retransmitted, or provided in any
manner to any unauthorized individual, office, or firm, except as otherwise
provided in these Rules and Regulations.
