ENFORCEMENT OF RULES OR DISPUTES
Section
9 - Consideration of Alleged Violations:
The MLS Standards Committee is responsible for
investigating all complaints alleging a violation of these Rules and
Regulations. SCCMLS may, at its discretion, require complaints to be submitted
in writing or by electronic means, including but not limited to email or an
electronic notification system built within the MLS system. If, in the
opinion of the MLS Standards Committee, the alleged violation is considered to
be a violation of Section 16, Standards of Conduct of MLS Participants or a
Request for Arbitration, the complaint shall be forwarded to the Grievance
Committee of the Arizona Association of REALTORS® for action in accordance with
the Bylaws.
Section
9.1 - Violations of Rules and Regulations:
If the alleged offense is a violation of the Rules and
Regulations of SCCMLS and does not involve a charge of one or more of the
provisions of Sections 16 (Standards of Conduct) of these Rules or a request
for arbitration, SCCMLS shall consider the alleged violation pursuant to the
procedures set forth in Section 7 hereof. If a violation is determined by the
SCCMLS, the MLS Standards Committee shall direct imposition of sanction(s)
according to the SCCMLS Penalty Policy as published at the time of the
violation, provided that the recipient of such sanction(s) may appeal such
determinations to the MLS Standards Committee and subsequently to the SCCMLS
Board of Directors in accordance with these Rules.
Alleged violations of Section 16 of the
Rules and Regulations shall be referred to the Arizona Association of REALTORS®
Grievance Committee for processing in accordance with the professional
standards procedures of the Board, except that if the charge alleges a refusal
to arbitrate, such charge shall be referred directly to the Board of Directors
of the Board.
Section 9.2 - Complaints of Unethical Conduct:
All other complaints of unethical
conduct shall be referred by the Board of Directors of SCCMLS to the
association of REALTORS® for appropriate action in accordance with the
professional standards procedures established in the State Professional
Standards level for processing.
