RISK MANAGEMENT
Foreclosures - Bank Owned Properties - HOT DEALS - FIRE SALES...
REO Properties are a hot topic in this market.  In our system approximately 8-10% of our listings are REO's. Although this means some smoking deals for some. This brings several red flags a waving. Disclosure being number one on the list. Banks/asset management companies depend on their selling/listing agent to notify them of state statutes & local requirements. Failure to comply with local laws & statutes is a violation in which an agent may be held responsible. Be sure you read & understand the bank addendums.  Fully disclose all pertinent issues and material facts to the seller and the prospective buyer. Make sure your E&O insurance covers your transaction (many carriers are not covering transactions involving the transfer of REO's). Check with your broker regarding their policy on handling these bank owned properties. Written communications are advised as part of your file.


COMMUNITY AFFAIRS
Is your license plate in violation?  New AZ law effective Jan 2009,
Starting Jan. 1, police can stop you if "Arizona" isn't clearly visible at the top of the plate. Violators will be fined an average of $135, plus court fees, depending on the city where the violation is discovered. It is up to the officer to determine if  the ARIZONA on your plate is clearly visible. The Arizona
Motor Vehicle Division is encouraging motorists to check their plates. Most license plate holders cover the ARIZONA totally or partially, they recommend removal.


TALKING POINTS

**  2009 Santa Cruz County Board of REALTORS® Association Fees in the amount of $461.00 were due on January 1, 2009.  Fees not received in the Board Office by January 31, 2009 will be considered late and membership will be suspended for the nonpaying member on February 1, 2009.  However, REALTOR® members may choose a payment plan to avoid suspension on February 1, 2009.  Notice of payment plan option must be on a Payment Plan Option form, signed by Agent and Broker and received by the Board Office prior to January 31, 2009.  If a payment plan is chosen an Installment fee of $2.50 per payment will be assessed. In 2009, Free education will be offered to members who have paid 2009 Association fees in full by February 1, as long as SCCBR budget allows.  To avoid suspension of membership all 2009 Association fees must be paid in full by 03/23/09.  Termination of membership will occur on March 31, 2009 for nonpayment of 2009 Association fees.

 

**   If you are choosing Option 2 or Option 3 for payment of 2009 Association fees you MUST complete a Payment Plan Option form by January 31, 2009 and return to the Board Office.  Please fax to 520-377-9614 or email to coboardofrealtor@qwestoffice.net

 

**  The Board Office will accept checks from the individual agents.  Santa Cruz County Board of REALTORS®  Policy #7- F1.  In the event a check presented for any account receivable is returned from the Bank because of insufficient funds the Executive Officer at her discretion may request that future payment be made only by certified funds or in cash.  The fee for each returned check will be in the amount of $25.00 plus bank fees charged.

 

**  Designated REALTOR® will receive a monthly invoice in February and March 2009 detailing the amount that has been paid, the balance due and the Option that the licensee in your office has chosen.

President's final comments...Looking forward to a brand new year. With hopes and faith that it will bring good things to all of us. Here's to letting go of the old 2008!
